The collection and automated processing of personal data aim to maintain the commercial relationship and to carry out information, training, advisory, and other activities specific to BADALAQUE. BADALAQUE informs you that, as a data hosting service provider and pursuant to Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the information essential to identify the origin of the hosted data and the time when the service provision began. The retention of these data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or for the safeguarding of public security, being made available to judges and/or courts or to the Ministry that so requires. The communication of data to the State Security Forces and Corps shall be carried out in accordance with the regulations on personal data protection.
Intellectual property rights of BADALAQUE
BADALAQUE is the owner of all copyright, intellectual property, industrial property, know-how, and any other rights related to the contents of the website www.badalaque.com and the services offered therein, as well as the programs necessary for their implementation and related information. Reproduction, publication, and/or use —other than strictly private— of the contents, in whole or in part, of the website www.badalaque.com is not permitted without prior written consent.
Intellectual property of hosted contents
Use contrary to intellectual property legislation of the services provided by BADALAQUE is prohibited, and in particular:

- Publication or transmission of any content that, in BADALAQUE’s opinion, is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.

- Collection and/or use of other users’ personal data without their express consent or in contravention of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
- Use of the domain’s mail server and email addresses for sending unsolicited bulk email (spam).
The user bears full responsibility for the content of their website, the information transmitted and stored, hyperlinks, third-party claims, and legal actions relating to intellectual property, third-party rights, and protection of minors. The user is responsible for compliance with applicable laws and regulations, rules concerning the operation of the online service, e-commerce, copyright, maintenance of public order, and universal principles of Internet use.
The user shall indemnify BADALAQUE for any expenses incurred as a result of any claim against www.badalaque.com where liability is attributable to the user, including legal fees and defense costs, even in the absence of a final judicial decision.
Protection of hosted information
BADALAQUE performs backups of the content hosted on its servers; however, it shall not be liable for accidental loss or deletion of data by users. Likewise, it does not guarantee full restoration of data deleted by users, as such data may have been deleted and/or modified during the period since the last backup. The services offered —except for specific backup services— do not include restoration of content retained in backups performed by BADALAQUE when such loss is attributable to the user; in such cases, a fee will be determined according to the complexity and volume of the recovery, subject always to the user’s prior acceptance. Restoration of deleted data is only included in the service price when the loss of content is due to causes attributable to BADALAQUE.
Commercial communications
Pursuant to the LSSI, BADALAQUE will not send advertising or promotional communications by email or any other equivalent electronic means of communication that have not been previously requested or expressly authorized by the recipients. In the case of users with whom a prior contractual relationship exists, BADALAQUE is authorized to send commercial communications concerning products or services of BADALAQUE that are similar to those initially contracted by the client.
In any event, after proving their identity, the user may request that no further commercial information be sent through the Customer Service channels.
